By accessing our website, www.relay.im (the “Website”), signing up for and/or downloading our social message mobile app, Relay (“Relay”), you consent to the use of your Personal Information as described in this Privacy Policy. You may withdraw your consent to our processing of your Personal Information at any time, but withdrawing consent may result in your inability to continue using Relay.

1. Collection of Information

   “Personal Information” is personally identifiable information such as your name, address, telephone number and e-mail address. We collect Personal Information from you via the Website and when you sign up to use Relay and log-in using your Facebook account, we will have access to your name, email address and other basic information through Facebook. The Personal Information we hold about you may therefore include, but is not limited to: your name, phone number and email address. We will also collect the email and phone number of your friends, if you choose to connect your contacts and address book information with Relay and we will store the Facebook IDs of your friends on Facebook when you login to Relay through Facebook. We may also collect Personal Information from time to time through other communications with you, information downloads, product or service purchases, user support and surveys. If you do not wish to receive such communications, you can opt-out of them in the manner indicated within each communication sent.

   We also automatically collect certain other information when you use Relay, such as your location/GPS coordinates (if you enable this feature), a device identifier (but not the UDID), MAC address, Internet Protocol (IP) address (if using a browser), operating system, the browser type, the address of a referring site and your activity on Relay. You can enable or disable location services when you use Relay at any time, through your mobile device settings. This information is not treated as personal information unless we combine it with or link it to any of the personally identifiable information mentioned above. We may also automatically collect certain information through the use of "cookies”. These are small files that your browser places on your computer. We may use both session cookies and persistent cookies to better understand how you interact with our services, to monitor aggregate usage by our users and web traffic routing on our services, and to improve our services. Most Internet browsers automatically accept cookies. You can set your browser to notify you when you are sent a cookie. This gives you the chance to decide whether or not to accept it. If you disable cookies, you may not be able to take advantage of all the features of the Website.

   Note: we do not intentionally collect personal information from minors aged 13 or younger. If we learn that we have collected personal information of a child under 13, we will take steps to delete such information from our files as soon as possible.

2. Use of Information

   We aim to collect, use and disclose only such information reasonably required to enable us to provide Relay, to respond to your inquiries and to improve our services. Except as set out in this Privacy Policy, your Personal Information will not be used for any other purpose without informing you first by updating this Privacy Policy.    We may use the information collected through Relay (including non-personal information) for the following purposes:

   • to monitor and analyze usage and trends, and to personalize and improve Relay and your experiences when you use Relay, such as providing content or features that match your profile or interests (including ads), and to increase the functionality and user friendliness of our services;
   • to send you confirmations, updates, security alerts, and support and administrative messages and otherwise facilitate your use of, and our administration and operation of, our services;
   • to allow you to add send your location in messages;
   • to find and connect with your friends;
   • to deliver messages and shared content to your friends
   • for any other purpose for which the information was collected.

   If you provide us access to your address book or sign in through Facebook, we will notify you each time someone from your address book or Facebook friends list signs up for Relay so that you can have the opportunity to contact that person and start sharing content with them through Relay. When you log-in to Facebook, any of your Facebook friends who are or become Relay users will be given the opportunity to share content with you. Other Relay users who are not your Facebook friends will also be able to find you and initiate contact based on any email address or phone number which you have associated with your account. Those Relay users will not have access to your email address or phone number but you will appear in a list of ‘Relay users’ with your name and profile picture visible and will be contactable by such users through Relay.

3. Disclosures & Transfers

   We will not share the Personal Information we have collected from you, except as described below unless we have your permission and/or have updated this Privacy Policy accordingly:

   • with other Relay users according to the preferences set in your account;
   • with certain social networking services, if you allow such sharing through our services;
   • we may share aggregated information and non-identifiable information with third parties for industry analysis, demographic profiling and other similar purposes;
   • when you give us your consent to do so, including if we notify you that the information you provide will be shared in a particular manner and you provide such information;

   From time to time we may employ third parties to help us improve our website, services and products. These third parties may have limited access to databases of user information or solely for such purposes. We are not responsible for the actions of service providers or other third parties, nor are we responsible for any additional information you provide directly to any third parties. Our servers are located in the USA and as such your Personal Information may be available to the U.S. government or its agencies under a lawful order made in that country, irrespective of the safeguards we have put in place for the protection of your Personal Information.

4. Important Exceptions

   We may disclose your Personal Information to a third party without your consent if we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other website users, or anyone else (including the rights or property of anyone else) that could be harmed by such activities. We may disclose Personal Information when we believe in good faith that such disclosure is required by and in accordance with the law.

   We may also disclose your Personal Information in connection with a corporate re-organization, a merger or amalgamation with another entity, or a sale of all or a substantial portion of our assets or stock provided that the information disclosed continues to be used for the purposes permitted by this Privacy Policy by the entity acquiring the information.

5. Links to Other Sites

   The Website and Relay may contain links to other sites. Any information you provide on those sites is provided directly to the owner of that site and is subject to that party's privacy policy. Our privacy policy does not apply to such sites, and we are not responsible for the content or privacy and security practices and policies of those sites.

6. Security

   The security of your Personal Information is important to us. We use commercially reasonable efforts to store and maintain your Personal Information in a secure environment and have implemented procedures designed to limit the dissemination of your Personal Information to only such persons who need access in order to carry out the stated purposes we have communicated to you.

7. Retention

   We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. If you request that your account details be removed from our databases, it may not be possible to completely delete all your Personal Information due to technological and legal constraints.

8. Amendment of this Policy

   Any non-material change (such as clarifications) to this Privacy Policy will become effective on the date the change is posted and any material changes will become effective 10 days from their posting on www.relay.im. Unless stated otherwise, our current Privacy Policy applies to all Personal Information that we have about you and your account and will apply to information collected from the date of the posting of the revised Privacy Policy as well as to existing information held by us. The date on which the latest update was made is indicated at the bottom of this document. We recommend that you print a copy of this Privacy Policy for your reference and revisit this policy from time to time to ensure you are aware of any changes. Your continued use of the website and Relay will signify your acceptance of any changes.

9. Access and Accuracy

   We will make every reasonable effort to keep your Personal Information accurate and up-to-date, and we will provide you with mechanisms to update, correct, delete or add to your Personal Information as appropriate. You have the right to access the Personal Information we hold about you in order to verify the Personal Information we have collected in respect to you and to have a general account of our uses of that information. Upon receipt of your written request, we will provide you with a copy of your Personal Information although in certain limited circumstances, we may not be able to make all relevant information available to you such as where that information also pertains to another user.
